A "slip and fall" case arises when someone is injured on somebody else's property as a result of the negligence of the property owner/tenant.
A prime example of a slip and fall case is when a shopper slips and falls on a wet floor at a store and is injured. An occurrence such as this, however, does not automatically justify that the injured shopper is entitled to benefits. The injured shopper must prove that the store personnel were negligent in maintaining a safe environment for its customers. For example, the shopper must prove that a store employee was aware of the wet floor but failed to adequately address the situation (e.g. failed to properly place customers on notice that the floor was wet, or failed to timely clean up the wet floor).
If you are injured as a result of a slip and fall, it is important that you report the incident immediately following your injury. Obtain documentation of the incident such as an Injury Report and insurance information of the responsible party. Also, jot down the names and phone numbers of any witnesses and of any employees who came to your assistance. The more information that you are able to provide, the better likelihood that your case will prevail.
